Terms & Conditions
Costs: Costs are based on double occupancy in hotels as specified in each itinerary. If you are traveling alone and wish to share accommodations, we will match you with a roommate if available. If none is available or if you prefer a single room, a single supplement fee will be applicable. Single rooms may not be available sometimes. Price inclusions vary and are listed on the detailed itinerary for each tour.
Price does not include: any items of a personal nature, travel insurance, additional expenses resulting from the delay or extension of a trip due to weather, political disputes, sickness or other causes beyond our reasonable control. Tipping your driver and guide at the end of the trip is normal, but entirely at your discretion.
Visa requirement: Visa fees for India are not included in the price. All US citizens require a passport and its validity must be for 6 months beyond the re-entry date into the United States. For the India Visa one can contact the nearest Consulate General of India office that has jurisdiction for your specific area. California residents can visit the website of Consulate General of India in San Francisco at http://www.cgisf.org/ for more information and instructions. Non U.S. Citizen/s may have different requirements. It is the responsibility of the passenger to ensure that all his or her visa and passport requirements are met. Please send a copy of the visa page from your passport after it has been issued to our mailing address.
Health Requirements: Health regulations for some countries visited on featured tours in this web site may require proof of inoculation and/or vaccination certificate; such certificate should be in your possession throughout the entire tour. We strongly recommend that you consult with your personal physician or Passport Health at 888-499-7277 or via the web at www.passporthealthusa.com in regards to your itinerary and required inoculations. The cost of trip cancellation insurance is not included in the price unless it is mentioned in an itinerary.
Cancelled Trips: India Traveller reserves the right to cancel any trip due to inadequate sign-up, which makes the trip economically infeasible to operate. Notification will be given at least 30 days prior to departure. A full refund will be given or you may choose to transfer to another tour.
Unused Tour Items: No refund will be made for any unused accommodations, missed meals, transportation segments, cruise portions, sightseeing tours or any other service. Such unused items are neither refundable nor exchangeable (no exceptions). Airline Clause: The airlines used in conjunction with tours and holidays featured in this web site are not to be held responsible for any act, omission or event during the time passenger/s is/are not onboard their aircraft. The passenger tickets in use by the airline, when issued, shall constitute the sole contract between the airline and passenger/s. Airfares, where used, are current at the time of air ticket purchase and are subject to change without notice.
Luggage: Arrangements include transportation and transfer of two standard-sized suitcases per person.
Airline Baggage Regulations: Economy-class allowance per tour participant permits two checked pieces of luggage per person, and subject to a total combined measurement of 106 inches (width + depth + height). No dimension of any single bag is to exceed 62 inches. The regional requirements for non-intercontinental flights are determined by weight, usually 44 lbs. per person in economy class (charter flights, if and when used, allow only 22 pounds, soft-sided luggage; limitations are strictly enforced). Carryon baggage is not to exceed 45 inches and must conform to underseat size requirements of 9x14x22 inches. Baggage and personal effects are at owner’s risk throughout the tour and baggage insurance is strongly recommended (see insurance clause). Carrier liability for tour members’ baggage is clearly stated on the passenger contract printed on all tickets; description can also be found for inspection at the airport or city offices of the carrier. Liability for checked and unchecked baggage shall in no event exceed the actual loss incurred by the passenger, subject to proof of the amount of loss. Please read all of the conditions of your ticket. Federal law and treaties limits the amount of recovery for loss of or damage to your luggage or its contents. To protect against such limitations, we strongly recommend that you purchase insurance (see insurance clause).
Photography/Filming: India Traveller reserves the right to take photographs/films during the operation of any program and to use resulting photographs/films for promotional purposes. Any passengers who prefer that their images not be used are asked to notify their tour escort at the beginning of the program.
Limitation of Liability: India Traveller, its owners, agents and affiliated companies act only as agents for hotels, transportation companies, land operators and suppliers of travel services and assume no liability in connection with the operation or service of any transportation vehicle or hotel which may be used for services to India Traveller trip members. India Traveller and its operators and agents will assume no liability for injury, damage, loss, accident, delay, irregularity or additional costs resulting directly or indirectly from any of the following causes: weather, failure of any means of transportation to adhere to schedules, quarantines, strikes, civil disturbances, theft, government regulations, or changes in transport and lodging beyond our reasonable control. India Traveller reserves the right at any time, either prior to or after departure, to, in its good-faith discretion, change or reprice any tour, including but not limited to the right to alter or omit any part of the itinerary, to substitute hotels or leaders, or change any means of conveyance without notice and without allowance of refund, with the liability of increased costs--if any--to be borne by trip members. India Traveller reserves the right to change any itinerary at any time when it is deemed advisory for the safety of the group or to comply with government restrictions.
Assumption of Risk and Release of Liability: India Traveller, Fresno, California and all affiliates act only in the capacity as an agent for the hotels, airlines, bus companies, railroads, ship lines, and/or contractors providing accommodations, transportation or other services to the client. The client is advised that India Traveller purchases such transportation, hotel accommodations, restaurant and other services from various independent suppliers who are not affiliated with India Traveller. India Traveller makes every effort to select the best suppliers of the aforementioned services, however, India Traveller does not control the operations of these agents and as a result, CANNOT BE HELD LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE OR OTHER CLAIM which may occur as the result of any and/or all of the following: (1) the wrongful, negligent or arbitrary acts or omissions on the part of the independent supplier, agent, its employees or others who are not under the direct control or supervision of India Traveller; (2) defects or failures of any vessel, aircraft, vehicle or other instrumentality which is under the control of an independent supplier; or (3) loss, injury or damage to person, property or otherwise, resulting directly or indirectly from any Acts of God, dangers incident to the sea, fire, breakdown in machinery or equipment, or wars (whether declared or not), hostilities, civil disturbances, strikes, riots, thefts, pilferage, medical epidemics, quarantines, or customs regulation, defaults, delays or cancellations or alterations in itinerary due to schedule changes, or from any causes beyond the control of India Traveller. Further, India Traveller is not liable for any loss or damage resulting from insufficient or improperly issued passports, visas or other legal documents. All coupons, exchange orders, receipts, contracts and tickets issued by India Traveller are issued subject to any and all tariffs, terms, and conditions under which any services are provided by such hotels, airlines, bus companies, railroads, ship lines or owners or contractors or by their person in employ. I acknowledge the risk and hazards of travel abroad/overseas. By signing this statement I accept responsibility for my own welfare and waive future claims against India Traveller for liability to the maximum extent permitted by law. I understand that India Traveller contracts with a network of operators abroad through affiliate tour operators. These third party service providers are deemed qualified and experienced to the best of knowledge of India Traveller. I understand, however, that India Traveller is unable to fully supervise or guarantee the performance of such third parties. Therefore, I fully release and hold harmless India Traveller from any and all liability for all their acts or omissions. I agree that this Assumption of Risk and Release of Liability statement shall be legally binding upon me, all minors under the age of 21 traveling with me, my heirs, successors, and legal representatives. I further agree to fully indemnify India Traveller from all and any liabilities to the maximum extent permitted by law and for all its costs, expenses, damages, etc (including attorney fees) arising from or attributable to any claims or actions arising from my travel with India Traveller and which claims or actions are specifically released by me in this document. I confirm that I have read, fully understand and agree to all the terms and conditions contained in this document.
